Distance Sales Agreement

1. PARTIES

1.2. BUYER

The BUYER's name, address, phone number, and email address are the details declared in the order form and constitute an integral part of this agreement.

2. SUBJECT OF THE AGREEMENT

The subject of this agreement is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, regarding the sale and delivery of the product/service ordered electronically by the BUYER via https://milenyumstudios.com.

3. PRODUCT / SERVICE AND PRICE SUBJECT TO THE AGREEMENT

The essential characteristics of the product/service, its quantity, the sales price including VAT, any delivery fee if applicable, and the total amount payable are itemized on the order summary screen and in the order confirmation email. This information constitutes an integral part of the agreement.

4. GENERAL PROVISIONS

• The BUYER declares that they have read and accepted the Pre-Information Form and this agreement before confirming the order.
• The product will be delivered to the address provided by the BUYER within the period specified in the order summary and in any case within a maximum of 30 days.
• Unless otherwise stated, delivery costs are borne by the BUYER.
• If the product must be delivered to someone other than the BUYER, the SELLER cannot be held responsible if that person refuses to accept the delivery.
• In cases where the ordered product cannot be supplied, the BUYER will be informed immediately and the collected payment will be refunded within 14 days.

5. PAYMENT

The price is collected using the payment method selected at the time of order. Card information is not stored by the SELLER; payment is processed through the secure infrastructure of a licensed payment institution. For installment payments, interest and commission are shown separately at the payment step.

6. RIGHT OF WITHDRAWAL

The BUYER has the right to withdraw from the contract without providing any reason and without paying any penalty within 14 (fourteen) days from the date the product is delivered to them or to the person they designate. For service provision, this period begins on the date the contract is concluded.

The withdrawal notice may be made within the period to the address [email protected] or to the number 08504664536. Following the notice, the product must be returned within 10 days.

7. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Pursuant to Article 15 of the Regulation on Distance Contracts:

1. Products whose price depends on fluctuations in financial markets beyond the seller’s control
2. Products prepared specifically according to the consumer’s requests
3. Products that are perishable or may expire
4. Products that are unsuitable for return due to health/hygiene reasons once the packaging is opened
5. Products that, after delivery, become mixed with other items and cannot be separated
6. Books, digital content, audio/video recordings, and computer consumables once the packaging has been opened
7. Periodicals such as newspapers and magazines provided outside of a subscription
8. Accommodation, transport, catering, and entertainment services that must be provided on a specific date
9. Services performed instantly and intangible goods delivered immediately
10. Services commenced with the consumer’s consent during the withdrawal period

8. RETURN CONDITIONS

• The product must be in its original packaging, unused, undamaged, and complete
• The invoice and any gift/promotion items, if applicable, must be sent together
• When using the contracted shipping company, the return shipping cost is borne by the SELLER
• The refund will be processed within 14 days after the product reaches the SELLER, using the same payment method

9. DEFECTIVE GOODS

If the delivered product is defective, the BUYER may choose one of the following rights: withdrawal from the contract, price reduction, free repair, or replacement with a non-defective equivalent. If the defect appears within 6 months of delivery, it is deemed to have existed at the time of delivery.

10. PERSONAL DATA

The BUYER's personal data is processed in accordance with the KVKK Information Notice and the Privacy Policy.

11. DISPUTE RESOLUTION

For complaints and objections, Consumer Arbitration Committees or Consumer Courts in your location are authorized, depending on monetary limits. The current monetary limits are announced annually by the Ministry of Trade.

12. EFFECTIVENESS

This agreement enters into force upon electronic approval by the BUYER, and a copy is sent to the BUYER's e-mail address.
